The Zoning & Land Regulation Committee voted 5-0 on October 27 to recommend approval with conditions of a Deerfield lot division using transfer of development rights.

The Dane County Zoning & Land Regulation Committee voted 5-0 on October 27 to recommend approval, with conditions, of a rezoning petition by Brian and Laura Larson for property at 4253 Larson Hollow Road in the Town of Deerfield. The petition, matter file 12339, would change the parcel from the RR-2 Rural Residential District to the RR-1 Rural Residential District to divide an existing residential lot and create one new lot using transfer of development rights. ## What the record shows The minutes, published October 29 and marked final unless amended by the committee, record a motion by Kroning, seconded by Peterson, that carried 5-0. The conditions assign the TDR-R (Transfer of Development Rights – Receiving) overlay district to the proposed new residential lot and the TDR-S (Transfer of Development Rights – Sending) overlay district to the sending property, a minimum 35 acres of parcel 0712-153-8000-1. A deed notice must be recorded on CSM Lot 2 stating that the lot was created by a transfer of development rights. An Agricultural Conservation Easement must be recorded on the minimum 35-acre sending property stating that further residential and nonfarm development is prohibited and that housing density rights for this portion of the original James Mickelson farm are exhausted under Town Comprehensive Plan density policies. ## What happens next The applicants must record the CSM with the Register of Deeds. The final CSM must satisfy a minimum 5-foot setback for the septic system drainfield and vents from the property line.
